What happens if I do not pay the the balance owed on my car repo?

Question by Don H: What happens if I do not pay the the balance owed on my car repo?
A few months ago I did a Voluntary REPO on my car. After the car was sold at auction I now owe 15k for the car. They have now sent my remaining balance to collections. And want me to start making monthly payments towards the balance. What happens of I do not pay the balance. I am thinking of settling but I am not sure if I should put that money toward paying that balance. What happends if I never pay anything? Will they ever write the balance off and just effect my credit report. I am trying to pay off old debt credit cards but I am thinking of paying this off first.

They can take you to court and win a judgment against you. If this happens your wages can be garnished in order to pay the balance. I would strongly recommend that you pay what you owe. Just because they wrote it off doesn’t mean they will stop in their attempts to collect.

Question by Btrouble: Loan company sueing me for loan even though they have not repo’ed the car. Can they do this?
Behind on loan note. Told company that I could not afford to fix car nor pay note right now and for them to come get it. Instead of repo’ing the car they filed a lawsuit for the whole loan note. I thought that they had to repo the car, sell it at auction, and then they could sue you for what was left.

find a loyer and have him/her to take care of it.. yes, they do filel a case. all u do, as i remember, just go to court and explane whats happening.. of course thats ugly, and i know that it would be better if they were to put a lin on the car or just come and take it.
